NOTE: We are also selling the Real Estate which includes the house, multiple shops/sheds/buildings and 10 acres, more or less. That auction is set up as a separate event. Bidding on the Real Estate ends at 1:00pm, same day.

A. No buyers premium. Sales tax is collected according to City, County and State Requirements.
B. All items sell as is, where is without warranty or guarantee.
C. It is our standard policy, not to describe condition of any item in this auction. If an item cranks and runs, we will simply state that. The vehicles in this auction have not been cranked in several months. Some do not have batteries. We have limited, solid information about the vehicles due to it being a U.S. Bankruptcy Auction. ALL, sell as is, where is! You may inspect the items in person on our inspection day which is July 30th from 9:30am until 3pm. You are welcome to bring your jump box to attempt to crank them.
D. All vehicles have a clear title unless stated on the item description. Pearce & Associates is a designated dealer and licensed automobile dealer and is required by law to prepare titlework for the purchaser. Non Alabama residents and licensed auto dealers will be sent the actual title and bill of sale. Alabama non dealers will have titles prepared by the auctioneer.
E. If you win an item in this auction, you must be prepared to pay for and remove the item on July 31st or August 1st. No Exceptions! This means bring your wrecker, rollback, trailer, forklift, tools, labor and any other item that you may need to disconnect, dismantle, load or haul away your purchases. We do not load or move!
F. You may pay by credit card, cash, bank wire or certified check made payable to Pearce & Associates. No personal or business checks on a Bankruptcy Auction!
G. You are required to register by credit card. Your credit card will not be charged unless: 1. You authorize our cashier to pay with your card on file at time of pickup or 2. You do not show up to pay for and remove your items by August 1st at 4pm. At that point, you agree to authorize Pearce & Associates to pay for your purchases and may forfeit your purchases to the U.S. Bankruptcy Courts or the Auction Company. Do not bid if you do not have the funds to pay! Non paying bidders will be turned over to the proper authorities for legal action.

If purchases are not settled within 3 business days of the close of the auction,<br>
it is in default. Upon default the bidder will be black listed on Pearce &<br>
Associates Auctioneers auctions as well as MarkNet auctions and<br>
will be charged for the merchandise. Defaulted items will be forfeited back to<br>
the owner or Pearce & Associates.<br>

Bidding info- When you bid your max the current bid price doesn't automatically go to<br>
your max bid. Someone else has to bid to increase the current price and the<br>
computer will automatically bid up to your max in the increments specified.<br>

This auction has what is called an auto extend feature, meaning the auction will not close until all bidding parties are satisfied. If any bids are placed within the last 5 minutes of the auction, the bid on lot(s) will extend for 5 minutes. The bidding will extend<br>
in 5 minute increments from the time the last bid is placed until there are<br>
no more bids, and the lot sits idle for 5 minutes. <br>

Pearce & Associates Auctioneers have put forth every effort to make accurate<br>
description of the items. Printed or verbal statements made by staff are<br>
matters of opinion and are made in good faith. However, all items are sold As<br>
Is Where IS. You are responsible for your own inspection during inspection<br>
periods.<br>

No allowance will be made for errors in cataloging, genuineness, defects, or imperfections not noted.<br>

All sales are final! A bid is a legal binding contract<br>

All accounts must be settled for at the end of the auction. Payment must be made with<br>
cash, a cashier’s check, money order, bank wire, credit card or checks with a bank<br>
letter of guarantee unless approved by the auction company. Final purchase price will<br>
include sales tax & buyer’s premium. Sales tax will be collected unless you are tax<br>
exempt and can provide us with a copy of your tax exemption certificate. Non Alabama<br>
residents are exempt from paying sales tax on vehicles. If payment is not received<br>
within 3 days accounts due will be charged to your credit card.<br>
